Charlie Kirk on Governor Phil Murphy Admitting He's Breaking Federal Immigration Law

Governor Phil Murphy of New Jersey openly admitted to harboring someone whose immigration status is uncertain, seemingly taunting federal authorities by saying "good luck to the feds coming in to try to get her." Charlie Kirk breaks down how this appears to violate 8 U.S. Code 1324, which makes harboring illegal aliens a federal crime punishable by up to five years in prison. Tom Homan responded sharply, promising to investigate and seek prosecution if the governor is knowingly breaking the law. Kirk argues that if Murphy is indeed violating federal law, an indictment should be filed without drama or spectacle—because no one, not even a governor, is above the law.

Federal Law on Harboring Illegal Aliens

8 U.S. Code 1324 establishes that harboring an illegal alien is a federal crime punishable by up to five years in prison. The law defines harboring as a felony that carries serious penalties upon conviction. Individuals can face five years for each instance of harboring, and up to ten years if the offense was committed for financial gain. The statute also makes it illegal to encourage or assist someone in entering or remaining in the United States illegally, with penalties that can include significant prison time depending on the nature and scope of the offense.

Governor Murphy's Controversial Statement

A clip surfaced of New Jersey Governor Phil Murphy in an interview where he appeared to brag about breaking federal law. Murphy discussed someone in his "broader universe" whose immigration status is uncertain, stating: "We said you know what, let's have her live at our house above our garage, and good luck to the feds coming in to try to get her."

The statement left many questions unanswered—whether the person is illegal, waiting for paperwork, or in some other immigration limbo. However, the way Murphy ended his statement seemed to taunt federal authorities, suggesting he is breaking the law and challenging them to do something about it.

Tom Homan's Sharp Response

Tom Homan, borders czar, had pointed words in response to Governor Murphy's statement. Homan said the governor's comments were "pretty foolish" and promised to investigate the situation thoroughly. He stated that if Murphy is knowingly harboring, concealing, or shielding an illegal alien, that constitutes a violation of Title 8 United States Code 1324. Homan made clear that he would seek prosecution, or the secretary would seek prosecution, if the investigation confirms wrongdoing.

Homan also addressed sanctuary cities more broadly, stating that the Trump Administration will take action because "sanctuary cities are sanctuary for criminals."

The Case for Prosecution Without Spectacle

If Governor Murphy is indeed breaking federal law and taunting federal authorities, an indictment should be filed. This doesn't require raiding the governor's mansion or creating a big spectacle—no dramatic press conferences needed. The approach should be straightforward and matter-of-fact: investigate the claim, and if it's true that the governor of New Jersey is harboring an illegal alien, file an indictment.

The process could be simple and professional. Inform the governor that he can turn himself in at his convenience, bring his state troopers if he wishes, and come in for processing. Give him a week to report to the Southern District of New York or the New Jersey U.S. attorney's office. There's no need for a Mar-a-Lago-style raid—just a clear message that he's breaking the law and has one week to turn himself in.

A Nation of Laws or Lawlessness

America must be either a nation of laws or it is not. Officials cannot selectively choose which immigration laws they will live under. If someone disagrees with 8 U.S. Code 1324, the proper remedy is to go to the House of Representatives and have them change the law through the legislative process. But no one gets to simply declare they won't live under those laws.

The irony is striking—these same officials told Americans during President Trump's first term that "no one is above the law." Now we have a governor admitting that he's breaking federal law. If the investigation confirms Murphy is harboring an illegal alien, he should face the consequences. He may try to make himself a martyr—a martyr for harboring an illegal alien against federal law—but the law must be applied equally to everyone, including governors.
