Tyler Robinson Trial Motion Denied: Defense Delay Tactic Fails as Justice for Charlie Kirk Moves Forward

Categories: Court Hearings
February 24, 2026

The court denied a defense motion to disqualify the Utah County Attorney's Office in the Tyler Robinson trial, rejecting what many saw as a delay tactic that could have postponed justice for months. The defense attempted to remove the entire prosecution team because one prosecutor's daughter attended the same location, but the judge ruled no conflict of interest existed. With May's preliminary hearing approaching, prosecutors are preparing to present extensive evidence against Robinson. Legal expert Jonathan Turley previously stated that even if 90% of the evidence were dismissed, Robinson would still face capital punishment. The ruling ensures the trial stays on schedule, bringing the pursuit of justice closer for Charlie Kirk and his family.

Court Denies Defense Motion to Dismiss Prosecution

A significant development emerged in the Tyler Robinson trial as the court denied a defense motion that sought to disqualify the entire Utah County Attorney's Office. The defense argued that a prosecutor assigned to the case had a concurrent conflict of interest because another prosecutor on the team had a daughter who attended the same location. The motion requested the removal of the entire prosecution office, a move that legal observers characterized as a delay tactic.

The court's ruling was clear and decisive. The judge stated: "Because defendant has not established a factual basis for finding conflict of interest or objective appearance of impropriety rising to a constitutional concern, his motion is respectfully denied." This denial ensures the trial maintains its current timeline rather than facing potential months of delays.

The Stakes of the Delayed Justice Attempt

Had the motion been accepted, the implications would have been severe for the pursuit of justice. The disqualification would have forced the case to transfer either to the Attorney General's office or to a different county entirely. This transfer would have resulted in months of delay and significantly complicated the proceedings. The new prosecution team would need time to familiarize themselves with the extensive evidence collected over months of investigation.

The delay would have also intensified public frustration. As noted during the discussion, people seeking justice need to see the legal process moving forward, not stalling on procedural technicalities. The glacial pace of legal proceedings has already tested the patience of those following the case, making this potential further delay particularly concerning.

May Preliminary Hearing: Mountain of Evidence to Be Presented

With the motion denied, all attention now turns to May, when the preliminary hearing is scheduled to take place. This hearing will mark a critical juncture in the case as the prosecution presents the extensive evidence accumulated against Tyler Robinson. Legal observers indicate that much of this evidence has not yet been made public, going beyond what appeared in the original charging documents.

The scope of evidence appears to be substantial. Legal expert Jonathan Turley reviewed the case and offered a striking assessment: even if the defense successfully eliminated 90% of the existing evidence, Robinson would still be found guilty and subject to capital punishment for the crime. This evaluation underscores the strength of the prosecution's case. Furthermore, there reportedly exists additional evidence beyond what has been publicly disclosed, creating what sources describe as "mountains more" of material yet to be revealed.

The Broader Context of Political Violence

The discussion expanded beyond the trial specifics to address the shadow of political violence hanging over the nation. The commentary highlighted vulnerability and concern ahead of major national addresses, noting how the threat of violence against conservatives and the MAGA movement overshadows political discourse. Representative Chip Roy received praise for addressing political violence in committee, though observers stressed that more work remains to root out this threat at a deeper level.

The impact of political violence extends beyond individual cases. It has claimed lives, including the namesake of the show being discussed, and has endangered President Trump and countless others in various administrations. This ongoing threat represents what speakers characterized as a tragedy and an evil that must be confronted and eliminated from American political life.

Next Steps in the Legal Process

With the prosecution team remaining in place and the trial schedule intact, the case proceeds toward the May preliminary hearing. Following that hearing, discussions regarding the death penalty are anticipated. The legal process continues to move forward, albeit at a pace that has tested the patience of all involved. The denial of this motion represents a victory for those seeking swift justice and demonstrates the court's commitment to maintaining the trial's momentum rather than allowing procedural maneuvers to derail the proceedings.

The case remains under close observation, with each development carrying significant weight for all parties involved. The preservation of the current prosecution team allows for continuity and expertise that has been building throughout the investigation, ensuring that the accumulated evidence and case strategy remain intact as the trial progresses.

[00:00] I do have breaking news from the uh

[00:04] Tyler Robinson trial.

[00:07] Uh Blake, and you've been following this

[00:09] along with us. So, there was a motion by

[00:12] the defense to dismiss the prosecutor

[00:14] because one of the prosecution's team u

[00:18] other prosecutors on the team had a

[00:20] daughter there and apparently they moved

[00:23] to disqualify the entire prosecution

[00:25] because of this. A motion, if accepted,

[00:28] would have delayed this trial

[00:30] enormously. I think it's difficult to to

[00:33] overstate that. And the court has now

[00:36] denied the motion, which is great news

[00:39] for justice.

[00:40] >> Yes, it was just it was a big delaying

[00:43] effort. It was kind of a it was a hail

[00:44] Mary. You'd force out all the

[00:46] prosecutors in the office. Uh then they

[00:49] would have to send it to either the AG's

[00:50] office or a different county. You delay

[00:52] it for months. You muddle the case more.

[00:54] you drive people more into a a frenzy

[00:57] about things because as we've said the

[00:59] best counter to a lot of the wild things

[01:01] we've seen online that we've seen in our

[01:03] own inboxes that we've seen on X is

[01:06] people want justice for what happened.

[01:08] They need to see the process playing out

[01:10] and it's been so frustrating to people

[01:13] seeing how glacial things are moving.

[01:16] It's been frustrating to us above all.

[01:18] We're we're constantly asking okay when

[01:20] is there finally going to be a journey?

[01:21] When is there finally going to be a

[01:23] trial? They were trying to drag it out

[01:25] even further and very thankfully the

[01:28] judge did rule against this motion. So

[01:31] that means we're going to at least stay

[01:32] on the schedule that we'd set before. So

[01:36] here's the actual language. The court

[01:38] now reads its ruling. We're getting

[01:40] video just breaking which will be made

[01:42] available and posted later today before

[01:44] the court defends its motion to

[01:45] disqualify Utah County Attorney's

[01:47] Office. Defendant argues that highle

[01:49] prosecutor

[01:51] assigned to this case has a concurrent

[01:53] conflict of interest and because no

[01:55] efforts were made to screen him, the

[01:57] entire office should be disqualified.

[01:59] Again, this is coming from the defense.

[02:01] This is a judge ruling. Because

[02:02] defendant has not established a factual

[02:04] basis for finding conflict of interest

[02:06] or objective appearance of impropriety

[02:08] rising to a constitutional concern, his

[02:11] motion is respectfully

[02:13] denied.

[02:16] So, as we looked, so this was a big one

[02:18] that we were we marked on the calendar

[02:19] to see if this case was going to get

[02:22] delayed or if the speedy trial promise

[02:25] that we are afforded uh is well, in his

[02:28] case, as the defendant was actually

[02:29] going to be met. But yes, to Blake's

[02:30] point, this was a this was a delay

[02:32] tactic. It has been denied by the uh by

[02:34] the court. So, we're grateful there. So,

[02:36] next landmarks to keep an eye on. We are

[02:39] all eyes on May. So May is going to be

[02:43] the big month and that is going to be

[02:44] the preliminary hearing where the

[02:46] prosecution team, which will now stay in

[02:48] place, is going to present the mountain

[02:51] of evidence that they have accumulated

[02:53] over uh the course of these months

[02:55] against Tyler Robinson. I'm told a lot

[02:58] of this is evidence that you have not

[03:00] seen or heard before. Some of it was in

[03:02] the original charging documents, but

[03:04] there is going to be additional

[03:06] evidence. And you know, I I just hearken

[03:10] back to the words of Jonathan Turley who

[03:12] reviewed this case and said that if 90%

[03:15] if the if the defense was successful in

[03:18] getting rid of 90% of the evidence

[03:20] against Tyler Robinson, he'd still be

[03:23] found guilty and subject to capital

[03:25] punishment for his crime. These days,

[03:28] the online world moves fast. That's why

[03:30] Tik Tok approaches teen safety with

[03:32] families in mind from the start. On Tik

[03:34] Tok, teens get over 50 built-in

[03:48] don't have to dig through menus or set

[04:11] And so to think that you could lose 90%

[04:14] of what we already know exists, still

[04:16] get a guilty verdict, but then there's

[04:18] even more that they haven't yet made

[04:19] public, mountains more potentially, is a

[04:23] very, I guess, comforting thought as we

[04:27] seek justice for Charlie. Blake, I don't

[04:30] know if you have any other thoughts on

[04:31] this matter, but no, I mean, this is a

[04:32] big moment. It is a it's just a genuine

[04:35] mercy. We're very happy to see it. Uh

[04:39] >> I think we have we can't talk about it

[04:42] as much for obvious reasons, but this is

[04:44] bit it's trying for us to observe it. It

[04:47] causes us a lot of stress to see updates

[04:50] like this and we do have to trust the

[04:53] process. And it's good when the process

[04:55] plays along and shows you what you want

[04:58] to see, which is this sort of thing.

[05:01] >> And we are loaded. We have the clip 404.

[05:04] >> The court now uh reads its ruling, which

[05:07] will be made available uh and posted

[05:10] later today.

[05:13] Before the court is defendant's motion

[05:15] to disqualify Utah County Attorney's

[05:17] Office. Defendant argues that highle

[05:20] prosecutor assigned to this case has a

[05:23] concurrent conflict of interest and

[05:25] because no efforts were made to screen

[05:27] him, the entire office should be

[05:29] disqualified.

[05:31] Because defendant has not established a

[05:33] factual basis for a finding of conflict

[05:35] of interest or an objective appearance

[05:37] of impropriy rising to a constitutional

[05:41] concern. His motion is respectfully

[05:44] denied.

[05:48] Good. And I guess we they they they're

[05:51] moving to a death penalty discussion

[05:54] upcoming. So, we're going to continue

[05:56] monitoring that. But this is I feel like

[05:58] been a really important show actually.

[06:01] You sometimes wake up in the morning and

[06:02] you don't know which ones are going to

[06:03] be important. When I saw that I think

[06:06] they're all important, but some are more

[06:07] more so. But when I saw that clip from

[06:09] President Trump, it was this moment of

[06:12] vulnerability from the

[06:13] commander-in-chief ahead of the what's

[06:17] typically considered the most or one of

[06:19] the most important addresses to the

[06:21] nation on the calendar. And so he's

[06:24] going to talk about,

[06:26] you know, the economy, the winds, focus

[06:28] on domestic tranquility and success.

[06:32] And

[06:34] overshadowing so much of this

[06:36] conversation tonight is this idea that

[06:40] the left wants political violence

[06:42] exacted upon its political enemies,

[06:44] conservatives. MAGA. God bless Chip Roy

[06:47] for addressing it in committee, but more

[06:50] work needs to be done. This needs to be

[06:52] rooted out at a very deep level. It

[06:54] stole our friend from us, the host of

[06:56] this show,

[06:58] whose name is still on this show. It has

[07:01] almost taken President Trump's life,

[07:03] countless others in the administration,

[07:07] and it is a paw that hangs over this

[07:09] whole country. It's a tragedy. It's an

[07:11] evil, and it must be blotted out. Pray

[07:13] for America. Pray for this country.
