State investigators testified that Robinson voluntarily turned himself in after informing his immediate family that he had been involved in Kirk's shooting.

New surveillance video allegedly captures Robinson on campus before, during, and after the fatal shooting. The footage shows an individual believed to be Robinson positioned on the edge of a building rooftop at precisely 12:23:28, the exact moment the reported shot was fired. After the shot, the individual stands up and moves across the building to the north.

Mountain of Evidence Presented

Prosecutors presented multiple forms of evidence linking Robinson to the crime:

  • DNA evidence allegedly connecting Robinson to the rifle used in the shooting
  • Ballistic evidence examined by the Bureau of ATF
  • Surveillance video showing the suspect before, during, and after the crime
  • Autopsy report detailing Kirk's death
  • Handwritten confession allegedly left by Robinson
  • Text messages between Robinson and his former roommate and partner

Expert Analysis: Unprecedented Defense Strategy

Former FBI Supervisor Special Agent James Gagliano described the state's presentation as "masterful," noting they have successfully laid out a comprehensive circumstantial case. "They already have, unfortunately, the body. They have the weapon. They have a motive," Gagliano explained. He emphasized that this preliminary hearing only requires prosecutors to present enough evidence to bind the case for trial, not prove guilt beyond reasonable doubt.

Gagliano noted the significance of the DNA technology being used, explaining that DNA evidence was first used in an American criminal case in 1987 and deals with statistics and probability theory. He characterized the evidence against Robinson as "a mountain of evidence, not just a little bit."

Defense Tactics Raise Ethical Questions

Criminal defense expert Donna raised concerns about the defense team's strategy, pointing out what she views as contradictory behavior. The defense has complained extensively about cameras in the courtroom and wanted coverage shut down, yet appears to be playing directly to the jury pool that will be watching and listening to the proceedings.

"What I find maddening here is you have this defense team that has complained incessantly about cameras in the courtroom and wanting to shut this down. But yet at the same time, are absolutely playing to what this jury pool is going to be listening to," Donna stated.

She explained that none of the defense's current tactics are necessary at the preliminary hearing stage, which has a very low evidentiary standard. "This is not a trial. This is a preliminary hearing, with a very low standard. None of this is necessary at this point."

Unusual Witness Scheduling

The defense took the unusual step of moving up one of their witnesses during the preliminary hearing. They called an FBI analyst who walked through complex technical details about evidence analysis. Gagliano noted he has never seen a preliminary hearing proceed this way, with the defense presenting witnesses so early in the process.

The hearing includes nine total witnesses: six for the state and three for the defense. By presenting their analyst early, the defense has shown prosecutors exactly what aspects of the evidence they plan to challenge at trial.

Red Herring or Legitimate Defense?

Donna suggested the defense is "truly walking a line between what is the right way to handle this and really pushing the limits to questionable tactics." She characterized much of the defense's presentation as "red herring information" designed to create doubt in potential jurors' minds rather than present exculpatory evidence.

"The bottom line is they don't need to be calling witnesses at all," Donna explained. "Nothing they're saying, it's not exculpatory evidence. They are challenging what the state is saying, which they will do at trial. This is not a beyond a reasonable doubt standard."

Both legal experts expect the judge to find probable cause and allow the case to proceed to trial, where the full defense strategy will unfold and prosecutors will need to prove guilt beyond reasonable doubt.
