[00:30] the documents so we can all look at this
[00:33] together and see what we have here
[00:36] because this is honestly pretty uh
[00:40] concerning for for several creators, for
[00:43] him especially. I I can't even imagine
[00:46] the stress that he feels going through
[00:48] this. This is horrible and so
[00:50] unnecessary. The some of the verbiage in
[00:53] here is worse than we thought. And so, I
[00:56] just figured we would go over it. So it
[00:58] says, "First, there was no fraud at
[01:00] Turning Point USA, much less more fraud.
[01:03] Your assertion otherwise is baseless and
[01:05] false. Second, ATP did not and does not
[01:09] have ghost employees. Rather, ATP had 80
[01:12] employees in FY23
[01:15] and 108 and FY24.
[01:18] There was however an inadvertent error
[01:21] in ATP's filing which failed to note
[01:23] these employees and at ATP is in the
[01:27] process of uh rectifying that
[01:30] inadvertent error but it is false to
[01:34] assert as you have done your on your
[01:36] YouTube show that ATP has ghost
[01:39] employees. Third, contrary to your
[01:41] statement on your YouTube show, there is
[01:43] nothing nefarious in TPA's
[01:46] increase donations during an election
[01:48] year. Donors naturally direct more money
[01:50] towards election activities in election
[01:52] years, especially to organizations like
[01:55] TPA
[01:56] that can engage in lobbying and
[01:58] political activity during election
[02:00] years. Accordingly, you are wrong to
[02:02] assert that the increased donations to
[02:04] TPA
[02:06] Evans Evans. Jeez, you guys. I can't
[02:09] even speak English today. Any sort of
[02:11] wrongdoing on Mr. Ber's part. December
[02:14] 7, 2025 episode. In your uh December 9th
[02:19] YouTube video, Top 10 Clowns of the
[02:21] Year, you made statements about supposed
[02:24] discrepancy concerning discrepancies
[02:26] concerning the use of drones at Utah
[02:28] Valley University on September 1025, but
[02:31] there was no discrepancy. UVU prohibited
[02:34] TPUSA from flying drones for security
[02:36] purposes during the event, but did allow
[02:39] a TPUSA media production drone to
[02:42] briefly fly over the location before the
[02:44] event to collect limited B-roll footage.
[02:47] In your December 14, 2025 episode,
[02:50] YouTube episode Tim Pool rants about
[02:53] Turning Point, you made several
[02:55] defamatory statements, including asking
[02:57] whether the money sent to 110 LLC was to
[03:00] bribe J. Hoffman and asking why ATP
[03:03] lists its COO Tyler Boyer as an
[03:06] independent contractor. First, TPUSA
[03:09] contracts with 110 LLC for legitimate
[03:12] services. The money you ask about is
[03:14] being spent on marketing and advertising
[03:16] services. Any claim that it is a bribe
[03:18] is false. Second, ATP lists its COO as
[03:22] an independent contractor because his
[03:24] substanti substantiative
[03:27] role from ATP is more in line with the
[03:30] contractor classification. More
[03:31] generally, you have accused the TP
[03:35] entities
[03:36] of being shell companies. This too is
[03:38] false. The substant substantative
[03:42] descriptions and roles of each of the TP
[03:45] entities can easily be seen by reviewing
[03:48] reviewing each organization's 990 claims
[03:52] that any of the TP entities is a show
[03:55] company is patently false. So let's just
[03:59] break down a little bit of this. So many
[04:01] things to say. We're going to try to
[04:03] keep it brief because we all know what's
[04:05] going on. Majority of you that are
[04:07] watching my content have watched other
[04:09] people's content. We can only say the
[04:11] same thing five different ways in all
[04:13] reality,

[07:17] really rich mailbox, then nobody would
[07:21] have to be doing any of this.

[07:51] heck you're putting out because we've
[07:52] had plenty of time, this is my opinion,
[07:54] allegedly, to fabricate whatever the
[07:56] heck we want. And now, too much
[08:00] information has come out where it's very
[08:01] clear that there's a whole lot of really
[08:04] good friendships with high up people
[08:05] that can change information all they
[08:07] want. They can change identities. They
[08:09] can change numbers around. They can
[08:10] delete stuff from the internet. they can
[08:13] uh they can do anything. We all know
[08:15] what they can do. I don't need to keep
[08:17] going on that. So, what do you expect
[08:20] from people? What did you what did you
[08:22] think was going to happen? I I really
[08:24] don't understand what they thought was
[08:26] going to come of all this. And in
[08:27] reality, it's not the people's fault,
[08:29] it's the government's fault because if
[08:31] they just would have did the right thing
[08:32] to begin with, we wouldn't even be here.

[08:37] page two. So, it says, "In your December
[08:41] 28th video of 2025, shocking turning
[08:44] point fraud gets worse. You recklessly
[08:46] repeated many of the previously
[08:48] described falsehoods and again directed
[08:50] viewers to the home address of Mr. Ber,
[08:53] which has resulted in threats to Mr. Ber
[08:55] safety. You also falsely suggested
[08:58] Turning Point Pack sent bribes to 110
[09:02] LLC when the payments were made for
[09:04] legitimate services. I am happy to
[09:06] provide you with further information
[09:07] confirming what I have set forth above.
[09:09] While the Turning Point entities have
[09:11] actionable and meritorious defamation
[09:14] claims against you, the TP entities are
[09:18] not looking for litigation, but yet
[09:20] you're sending
[09:22] literally a ceaseentist. I mean, what do
[09:26] you call that? Then why didn't you just
[09:28] send a certified letter from one person
[09:30] to another?
[09:32] What this is you guys in my opinion this
[09:35] is a game of chicken. They are bluffing.
[09:39] This is my opinion. I dare them with
[09:43] every dollar I have which
[09:47] isn't much that they are not going to
[09:51] sue because that brings in discovery and
[09:53] the discovery would be glorious.
[09:56] So I think this is a scare tactic to be
[09:59] quiet. Don't do this. We're not, you

[10:03] looking for litigation. Uh ask us for
[10:06] for what information you need to put out
[10:08] there and like you can put it out there.

[10:12] comprehend and like put information out
[10:14] there. So just like ask us what it is
[10:15] and like we'll tell you we'll tell you
[10:17] what the narrative is, you know? Don't

[10:22] you publish anything more about any of
[10:24] the TP entities or their finances as I
[10:26] can provide you with accurate
[10:28] information to answer any legitimate
[10:30] questions you may have. Otherwise, you

[10:34] maliciously if you go ahead and publish
[10:35] further unsupported assertions about TP
[10:38] entities without giving me the
[10:39] opportunity to provide you with the
[10:41] truth in advance, aka your narrative.

[12:39] emails from all the email accounts, both
[12:41] personal and business, calendar and
[12:42] contract information, electronic chat
