He applied the same framework domestically to California's threatened criminal penalties for misgendering, arguing that a law capable of jailing someone over pronoun usage crossed from ordinary anti-discrimination policy into compelled speech and government control over language itself. Kirk turned the authoritarianism charge back on the American government directly in a separate segment, pointing to Steve Bannon's prosecution and Douglas Mackey's conviction over a political meme as domestic examples of the exact behavior America routinely sanctions foreign governments for committing against their own dissidents.
