[00:00] People who are spreading conspiracies
[00:02] that are unverified are unwittingly,
[00:05] some of them are wittingly, propping up
[00:08] a defense for the defense team. If this
[00:11] shooter is the shooter, you are doing
[00:13] more harm than good by coming up with a
[00:16] defense attorney's arguments to create
[00:18] reasonable doubt. Tyler Robinson didn't
[00:20] kill Charlie Kirk. Charlie Kirk's
[00:22] Israeli security detail killed Charlie
[00:24] Kirk. And Charlie Kirk's assassin is
[00:26] caught on tape. If you think that
[00:28] TurningPoint USA had anything to do with
[00:30] this, or you think that Turning Point
[00:31] USA should somehow release footage of an
[00:34] incident that's currently under
[00:35] investigation, but without accurate
[00:38] information, you should shut your mouth.
[00:43] People who are spreading conspiracies
[00:46] that are unverified are unwittingly,
[00:49] some of them are willingly, propping up
[00:52] a defense for the defense team. And this
[00:54] is not my own thought. another guy uh
[00:56] came up with this idea and I thought it
[00:58] was brilliant that he mentioned it and I
[00:59] think it's 100% true. If this shooter is
[01:02] the shooter, you are doing more harm
[01:04] than good by coming up with a defense
[01:06] attorney's arguments to create
[01:08] reasonable doubt. So therefore, you
[01:11] could create an environment in a
[01:13] situation that taints a jury pool that
[01:16] also creates reasonable doubt that if
[01:18] this is the actual suspect, the suspect
[01:19] could get off in the crime. Is do you
[01:21] want that on your consciousness? You
[01:23] claim that you love Charlie and you love
[01:26] Turning Point USA. You claim that you
[01:27] support the movement, whoever that you
[01:30] are, and I see a ton of you guys, and
[01:32] I'm going to expose a few of them right
[01:33] now, that are saying things that are
[01:35] unourred and that will cause problems in
[01:38] the investigation. You are absolutely
[01:41] unequipped to speak on a subject. If you
[01:44] think that Turning Point USA had
[01:45] anything to do with this, or you think
[01:47] that Turning Point USA should somehow
[01:48] release footage of an incident that's
[01:51] currently under investigation,
[01:53] this is not a game. This is not a talk
[01:56] show. This is not a reality show. This
[01:59] is not social media. This is these are
[02:01] real people doing a real investigation
[02:03] that have real people's lives on the
[02:05] line. And it bothers me to no end that
[02:08] people continue to push conspiracy
[02:09] theories. It's okay to question, but
[02:12] without accurate information, you should
[02:15] shut your mouth and let the
[02:16] investigation yield results that you can
[02:20] then critique. The Fed has finally
[02:22] dropped interest rates, and that's great
[02:24] news for American homeowners. Expenses
[02:27] have been major burdens on the family.
[02:29] Wages have been flat. Prices keep
[02:31] climbing. And for many, the only way
[02:33] that you can make ends meet is leaning
[02:36] on credit cards. But that cycle has high
[02:38] interest debt making it hard to stay
[02:40] ahead. If you're a homeowner, I want you
[02:43] to call my friends at American
[02:45] Financing. Right now, interest rates
[02:47] have dropped. Many homeowners are seeing
[02:49] options in the low fives compared to
[02:52] credit card charges rates that are in
[02:54] the 20s or higher. There's an easy path
[02:57] to see how you can fully put your
[02:59] hard-earned equity to work for you.
[03:01] American Finance can help you pay off
[03:03] that expensive debt, free up your cash
[03:05] flow, and keep your budget under
[03:07] control. Their salarybased mortgage
[03:09] consultants are saving customers on
[03:12] average $800 a month. And if you start
[03:15] today, you may even be able to delay
[03:18] your next mortgage payment. So, take
[03:20] control. Call my friends at American
[03:21] Finances today. 866889810.
[03:25] That's 866889810
[03:28] or americanfancing.net/tum.
[03:31] I'm gonna show it here in a minute, but
[03:32] in the hearing that was presented today
[03:35] on the topic, both the defense and
[03:37] prosecution admitted that there's tons
[03:40] of evidence to go through that the
[03:42] defense says that they need more time to
[03:45] diagnose the plethora of evidence that
[03:47] they're going to have to evaluate to
[03:49] defend the def the the defendant. They
[03:52] also made claims clearly that there's so
[03:55] much electronic communication that they
[03:57] need ample amount of time to go through
[03:59] all the electronic communication. What
[04:01] does that mean? That means that the
[04:02] little cell phone stuff that you think
[04:04] you saw or that you saw that you think
[04:06] you know the totality of is not the full
[04:09] story. They're going to extract
[04:11] electronic communications from his cell
[04:13] phone, her cell phone or or the boy cell
[04:15] phone that he dating that transition.
[04:17] They're going to extract electronic
[04:19] communication from the dad's cell phone.
[04:21] They're going to extract electronic
[04:23] communication on Discord. and he said
[04:25] that there's more than 20 or 30 people
[04:27] that either communicated with or knew
[04:29] about the inferences of the defendant
[04:32] killing Charlie. Let the information
[04:35] come out and then critique it because
[04:38] there's going to be so much information
[04:40] in this trial and it's going to be
[04:42] presented live for the world to see.
[04:44] Evidence from OM the autopsy experts on
[04:48] ballistics. It's going to be so much
[04:49] information. You ignorant folks, if you
[04:52] have the if you have any integrity, wait
[04:55] till there's information presented and
[04:58] critique the information instead of
[05:00] critiquing a a straw man. And then what
[05:03] happens is you lie about everything and
[05:05] then when the truth come out, you just
[05:07] go on to the next lie. Let's go with Stu
[05:09] Peters, who is the nuttiest person on
[05:11] planet Earth. I I think I know I thought
[05:13] I went on his show before. I said I've
[05:14] seen him before. He is the nuttiest
[05:17] person on planet Earth. I thought that
[05:20] others were nutty. He is the nuttiest. I
[05:23] thought it was a parody until I realized
[05:25] what this fool is saying. Let just roll
[05:28] one clip. Tyler Robinson didn't kill
[05:30] Charlie Kirk. Charlie Kirk's Israeli
[05:32] security detail killed Charlie Kirk and
[05:34] Charlie Kirk's assassin is caught on
[05:36] tape. Blake Bednar has brought us this
[05:38] video. We'll break it down. Take a look
[05:40] at this. Here it is from the wide angle.
[05:41] Watch Charlie Kirk's right side of his
[05:43] t-shirt. Watch the lavalier lapel mic.
[05:46] Do you see it explode?
[05:48] Let's bring it in just a little bit
[05:49] closer. Watch this. Put it in a freeze
[05:51] frame. That is the explosion from
[05:53] Charlie Kirk's lavalier lapel mic. Want
[05:56] to see it again? Bring it in closer.
[05:58] Remember when we told you that was
[05:59] >> this guy is stupid. I I don't want to
[06:01] show too much of Charlie, but he think a
[06:03] lavalier exploded. Somehow the lavalier
[06:07] exploded and then went on this side of
[06:09] Charlie's neck and penetrated and and
[06:11] killed him. We we the lavalier explodes
[06:13] and goes on other side and kill. There
[06:15] is no evidence on no video that nobody
[06:18] has ever presented or saw a entrance
[06:20] wound on the other side of his neck.
[06:23] Where are you getting that the lavalier
[06:25] has precision munition in it that will
[06:28] shoot one round through this side and
[06:31] out this side? If that if it has the
[06:33] velocity to shoot a round through from
[06:35] this angle, it's not going to come out
[06:37] this side. And if IT'S IF IT'S HOW DID
[06:40] IT COME AND IF IT has enough velocity to
[06:43] blast from here, come in and out of this
[06:45] side, in this side, out of this side,
[06:46] it's going to hit somebody that's
[06:49] standing right next to him. His Israeli
[06:52] team, these people WERE HIRED BY TURNING
[06:55] POINT AND THEY SERVE, many of them
[06:56] served in the United States military or
[06:59] law enforcement. I know these GUYS
[07:01] PERSONALLY. WHAT ARE YOU talking about,
[07:03] bro? Now it's a lavalier, Mike. So, so,
[07:06] so the, so you're saying the team is
[07:08] involved because they Nick, help me the
[07:12] they travel with the lavalier mic that
[07:15] they use for Charlie all the time. The
[07:17] same one that they put on me when I go
[07:20] to the event. And if you have a lavalier
[07:23] mic with munition that's powerful enough
[07:26] to kill you, THAT LAVALIER MIC WILL BE
[07:28] SO heavy you couldn't use the magnetic
[07:30] hold on it. It will be draping down his
[07:32] shirt. You stupid idiot.
[07:37] Finish the clip. Absolutely. An exit
[07:39] wound. Yeah, it is. Check the trajectory
[07:41] of the round that was deployed from that
[07:43] lavalier lapel mic that went directly
[07:46] from Charlie Kirk's lapel that went
[07:48] directly from underneath Charlie Kirk's
[07:50] white t-shirt up through his neck and
[07:53] created the exit wound that we told you
[07:55] was an exit wound immediately when we
[07:57] saw
[07:57] >> All right. I don't like to see Charlie
[07:59] like that. Roll this. Let's get off of
[08:01] that for a second. But
[08:04] the lavalier mic shot him but didn't
[08:06] explode cuz the thing is hanging right
[08:09] here.
[08:12] Okay, it's get it gets worse now. Here's
[08:15] Nick Fuentes who is another idiot who's
[08:19] criticizing Erica Kirk's response to her
[08:23] her husband's
[08:24] assassination
[08:28] wrote a clip.
[08:30] >> It's like lady
[08:33] Didn't your husband just get his face
[08:34] blown off like two seconds ago? And not
[08:36] to be insensitive about it, but
[08:38] everyone's thinking it. No one wants to
[08:41] be the No one wants to say it.
[08:44] Everyone's thinking it. Everyone was
[08:46] thinking it when she gave the first
[08:48] speech. Everyone was definitely thinking
[08:50] it at the memorial. Nobody wants to say
[08:52] it because it's inappropriate. It's
[08:55] insensitive.
[08:57] I I am the uh the troll, right? So, I'll
[09:01] be the one to say it. I think it's super
[09:03] inappropriate. I think it's
[09:04] inappropriate. I think it's weird. It's
[09:07] bizarre. Something is off there. And I
[09:10] don't like it. But they're doing the
[09:13] Super Bowl commentators with the
[09:14] headsets on doing a media table. They're
[09:17] selling merch, registering voters. They
[09:19] got pyrochnics.
[09:22] Is this Wrestlemania or is this a
[09:24] funeral? Like, what are we doing here?
[09:25] And then the day after the funeral, I'm
[09:28] getting 500 texts and emails. Erica Kirk
[09:32] here. I miss him every time I blink.
[09:35] Every beat of my heart. Make sure to
[09:38] donate. $5, $15, $25. It's like, okay.
[09:43] Then they're doing a show. Did you see
[09:45] the show today?
[09:48] And so preient. I said it last night. I
[09:51] said, I'm getting like a fake vibe. I'm
[09:53] not. Something's off there.
[09:57] And people say, "Well, everybody
[09:59] grieavves differently." Yeah, I don't
[10:01] know how much mileage we can get out of
[10:03] that one anymore. Something's not right
[10:05] there.
[10:07] Very bizarre, weird vibe there. And did
[10:11] you see the show? Erica hosted the
[10:13] Charlie Kirk show this afternoon and
[10:16] she's like,
[10:18] she looks like she's over the moon.
[10:20] She's happy as a clam.
[10:23] And again, I'm not who am I to judge?
[10:26] Everybody grieavves differently. She's a
[10:28] very devout Christian. Some people say
[10:30] maybe that's just strength. That's
[10:32] resolve. I don't know.
[10:35] It's one thing if your husband dies,
[10:38] period. It's another thing if your
[10:40] husband dies at age 31 unexpectedly.
[10:44] It's another thing if your 31-year-old
[10:46] husband unexpectedly dies because he
[10:48] gets publicly executed with blood
[10:51] gushing out in front of thousands of
[10:52] people screaming and running away.
[10:54] That's like something that's altogether
[10:57] different.
[10:57] >> How many seconds? Oh, thank God it's
[10:59] over. What an idiot. What a I don't know
[11:03] how people think this dude is a normal
[11:05] person that they should platform other
[11:07] than kicking his butt verbally on a
[11:10] debate. Like, do you not have any
[11:14] intuition or wisdom? Do you not believe
[11:17] in God? These fake Christians like Nick
[11:20] Fuentes who trash Charlie forever and
[11:23] call Charlie a fake Christian. Look at
[11:25] his theology of Erica Kirk, dummy some
[11:30] people, because you're a maniac and you
[11:33] don't have any emotional intelligence.
[11:35] Some people know how to put on the face
[11:38] that they need for their HUSBAND'S
[11:40] LEGACY TO DO WHAT SHE got to DO TO
[11:43] CONTINUE HIS LEGACY. WHAT KIND OF EFFING
[11:48] WOMAN WOULD JUST SIT AT HOME AND CRY all
[11:50] day when SHE WAS MARRIED TO A SOLDIER? A
[11:54] MAN WHO STOOD ON PRINCIPLE THAT FOUGHT
[11:57] EVERY DAY FOR AMERICAN VALUES THAT
[11:59] TRAVELED ALL OVER THE COUNTRY. SHE'S
[12:01] MARRIED TO THAT GUY THAT PRAYS OVER HIS
[12:03] FAMILY, that supports his family,
[12:05] surrounded by patriots who have
[12:08] something in them that's greater than
[12:10] what the world is offering, and she can
[12:13] step up to the plate TO HONOR HER
[12:15] HUSBAND AND SHE PROBABLY CRIES AT HOME
[12:17] ALL NIGHT. THAT'S LIKE SAYING, BRANDON,
[12:20] you don't cry every time you get on the
[12:21] thing. I have cried multiple times over
[12:23] what happened to Charlie, but I know how
[12:24] to compose myself enough to fight the
[12:27] good fight. These people are stupid
[12:30] saying they talk Erica's speech when she
[12:32] first did it. She was crying and she was
[12:35] but you you want to judge her on what?
[12:38] Show me an example of a person who lost
[12:40] their husband the way she lost Charlie.
[12:42] And what did they say in response? How
[12:44] was their first speech? The woman is
[12:47] continuing his legacy. I got the
[12:48] messages. I love him. I miss him. What
[12:51] else you want her to do? Say, "Let's
[12:53] forget about it." It it makes your
[12:55] husband's death even worse if you
[12:57] sitting around crying about it and
[12:58] you're not helping further the mission.
[13:01] Good people that believe in God
[13:02] understand that God has a plan and that
[13:05] God's plan is bigger than ours. When you
[13:07] Nick Fuentes, you don't believe in God.
[13:09] I don't know what God he believe in. You
[13:11] somehow think that you should be
[13:12] consumed by worldly uh uh events and
[13:15] emotionalism and not by the spirit of
[13:17] God that gives you grace and gives you
[13:20] passion to keep going. That's like
[13:22] saying that the apostles when Jesus was
[13:24] crucified on the cross somehow they
[13:26] supposed to sit around and cry all day.
[13:27] That Mary was supposed to sit around and
[13:29] cry all day. No, they said they killed
[13:32] my son. Mary said they killed our
[13:35] brother and we must continue on even in
[13:38] the face of death. And that's what the
[13:40] apostles did. Let's we got we got
[13:41] another clip from him talking about uh
[13:44] Charlie was in an arranged marriage with
[13:45] Erica. Wrote a clip.
[13:49] Um, you know, the thing about Erica Kirk
[13:51] is I 100% believe that that's an
[13:54] arranged marriage.
[13:56] Charlie and Erica, I do not believe for
[13:59] one second that they met organically.
[14:04] How do you think they met each other? Do
[14:06] you think that they bumped into each
[14:08] other at CPAC and Charlie said, "Hey,
[14:10] let's go on a date."
[14:11] >> Hold on.
[14:12] >> No, they were set up.
[14:13] >> Hold on. This is why you know he's
[14:16] stupid. All you got to do is listen to
[14:18] Charlie over the last several years
[14:20] explain how he met Erica. She applied
[14:23] for a job at Turning Point USA. In the
[14:26] interview, they connected and he said,
[14:27] "You know what? Uh, you can't work for
[14:29] me because you're going to be my woman."
[14:31] That's normal behavior. A young man like
[14:34] Charlie Kirk is probably open to having
[14:37] a wife, beautiful,
[14:39] smart, intelligent, articulate woman got
[14:44] something going for herself. Her resume
[14:46] is probably insane. A man look at her
[14:49] and say, "Wait a minute. You you you
[14:51] gonna be a you you work be a influencer
[14:54] or whatever you No, you wifey material."
[14:57] He speak he see so many women and there
[14:59] is not many women that can lead or or be
[15:02] in a position to be a part of his life
[15:05] to take him to the next level. I met my
[15:08] wife similarly to that. My wife was uh
[15:10] she was on social media or whatever and
[15:12] I knew she lived in California. I
[15:14] invited her to an event. the Nessa Susie
[15:15] event. I was talking to another woman. I
[15:17] mean, we was trying to date another
[15:18] woman. I just liked Korean because she
[15:20] was very sweet and she was nice and I
[15:21] like she was a patriot. And so I invited
[15:24] her to the event. Didn't think nothing
[15:25] of it. The girl that I like, she had to
[15:27] go somewhere else. She couldn't go to
[15:28] dinner with the rest of everybody else.
[15:29] But Korean went and me and Karen talked.
[15:32] She embarrassed me. Well, I embarrassed
[15:34] me. She blasted me because my social
[15:35] media sucked. She said, "Bren, let me
[15:37] help you with this social media." I
[15:38] didn't want nothing to do with Korean.
[15:40] She was good-looking, but she lived in
[15:41] California and I ain't never living in
[15:43] California. I had never moved from
[15:45] Arizona. That's what my mind was. And I
[15:47] don't have time to be dealing with women
[15:49] really. And I thought she was bougie,
[15:51] too, cuz she had Louis Vuitton. And now
[15:52] I know she thrift all that stuff and
[15:54] she's smart about her money. But then
[15:55] over time, bro, she started helping my
[15:58] social media. Then she started being
[16:00] like a like uh to help me with my
[16:01] speaking engagements, kind of like a a
[16:03] manager. And then after a while, I say,
[16:05] "Well, wait a minute. This woman is
[16:07] beautiful. She's conservative. She's
[16:10] smart. She a grown woman. She got her
[16:12] stuff together. She adds so much value
[16:15] to my life. What am I? This is wifey
[16:17] material. This the kind of woman I want
[16:19] to marry and I married her. But when you
[16:22] a little incel uh uh wanking off at
[16:26] night to to I don't know uh uh anime
[16:30] bunny ears. Y'all see the guy he was
[16:31] with doing bunny ears probably probably
[16:33] on the back of him at night. When you
[16:35] doing stuff like that, you don't
[16:36] understand the value of what women bring
[16:38] to the table. This dude is in his age
[16:40] and he don't got no girlfriend or
[16:41] nothing. We know what that is, bro.
[16:43] You're gay probably and ain't nothing
[16:45] wrong being gay. That's what you're
[16:46] going to do. But don't be in the closet
[16:47] about it. You running around talking all
[16:49] this Christian stuff and you the dumbest
[16:51] person on earth with no wisdom. Charlie
[16:54] arranged marriage. Where your evidence
[16:56] that this is arranged? Everybody that
[16:59] got married that I know in Turning
[17:01] Point, a lot of them young people met
[17:03] they people at a Turning Point event.
[17:05] They work with them. They ran into them.
[17:08] What are y'all talking? THIS IS WHAT
[17:09] HAPPENS WHEN you in the movement. You
[17:11] run into somebody that's your wife. But
[17:13] when you a weirdo sitting in your
[17:14] parents house making little videos like
[17:17] being a racist, no woman want you
[17:18] anyway. Who you who what woman going to
[17:20] want Nick Fuentes? You ain't got nothing
[17:22] to offer. You too stupid not to have a
[17:25] build a platform or something for
[17:26] yourself. You go on these podcasts, you
[17:29] a little groper. You make your little
[17:30] YouTube stuff, but you're not desirable
[17:32] for a woman to be with. You have no
[17:35] nothing to offer. Anyway, I will go on,
[17:38] but I need to move on to my next topic.
[17:40] But the court proceeding happened and
[17:43] we'll play it in post-production so you
[17:45] guys can see it.
[17:47] Council, as we begin, I have entered
[17:50] orders allowing the admittance of Mr.
[17:53] Michael Bert, Mr. Richard Novak, Prohawk
[17:56] Viche, and appointing them along with
[17:58] Miss Katherine Netor
[18:01] uh to be Mr. Robinson's counsel. The
[18:04] court enters findings that the combined
[18:06] experience of council meets and exceeds
[18:09] the requirements of rule 8.
[18:12] Council, do we have uh what would what
[18:16] would we like to accomplish today?
[18:19] Uh I have two items, judge. I just
[18:21] wanted to make a record that under rule
[18:23] 16 of the Utah rules of criminal
[18:25] procedure with respect to discovery uh
[18:28] the state is required to provide to the
[18:30] defense within 5 days of the defense's
[18:33] request the discovery that we relied on
[18:35] in making this charging decision. We'll
[18:38] prepare to we'll be be prepared to do
[18:40] that. So we'll look for uh uh defense
[18:42] council's um request or the next day or
[18:46] so and we'll provide that to the
[18:47] defense.
[18:48] >> Thank you. Um, we also for the court's
[18:51] information, we met this morning with
[18:53] the defense team briefly in our office
[18:55] to talk about discovery and the process.
[18:58] So, we'll be working together. There is
[19:00] a substantial amount of discovery in
[19:02] this case, your honor. It's voluminous
[19:05] to say the least. Um, and we're working
[19:07] on a process where we can exchange
[19:09] information as quickly as possible and
[19:12] be efficient in that process.
[19:14] Um, the other item I had, your honor, I
[19:17] saw that over the the weekend there was
[19:19] a protection order, pre-trial and trial
[19:21] publicity order entered by by your
[19:24] honor. And I just was seeking some
[19:26] clarification on page two uh at the end
[19:29] of the first paragraph.
[19:31] It reads, "To that end, lawyers
[19:34] participating in the investigation or
[19:36] litigation of this case shall inform all
[19:39] witnesses, investigators, consultants,
[19:41] staff members, or other members of the
[19:43] prosecution or defense teams that the
[19:45] prohibitions contained about the
[19:47] prohibitions contained in this order."
[19:49] Um, the state, we're seeking some
[19:52] clarification with respect to the phrase
[19:54] all witnesses, your honor. Um
[19:58] there are a number of witnesses that
[19:59] have yet to be identified uh that would
[20:02] likely be used in the state's case. Uh
[20:04] this occurred in front of 2 to 3,000
[20:06] students at Utah Valley University. Uh
[20:09] so we're in the process of identifying
[20:10] those witnesses. And so those
[20:12] individuals are presently unknown right
[20:14] now. So we're looking for a little
[20:16] clarification from the court. Um and I
[20:19] suppose uh we're not going to make any
[20:20] arguments today, but there may be some
[20:22] follow-up pleadings that we may need to
[20:24] file.
[20:26] Uh, Miss Nester, did you want to be
[20:28] heard about that issue?
[20:30] >> No, your honor, we would defer to
[20:32] whatever the court wants to advise them
[20:34] on that matter. Um, I mean, I think it's
[20:37] fairly obvious that we don't know who
[20:39] all the witnesses are in this case yet.
[20:41] Um, I think it's just important that if
[20:43] anyone um is identified that they have
[20:46] information about this order. So, I
[20:48] think other than that, we wouldn't weigh
[20:50] in on any other matter.
[20:52] >> Thank you. They are inherently due
[20:54] because they are human beings. Let me be
[20:57] clear. I will not put my finger on the
[21:00] scale of justice. These proceedings will
[21:02] be open to the public, conducted in
[21:05] accordance with the law, and handled
[21:07] with diligence and competence to ensure
[21:10] that justice is never compromised. It is
[21:14] the standing order of this court that
[21:15] Mr. Robinson shall be allowed to appear
[21:17] in person so he can fully engage with
[21:20] his attorneys and participate in these
[21:23] legal proceedings.
[21:25] Council, regardless of who is watching,
[21:28] whether it is the nation or a single
[21:31] individual, we must fulfill our roles
[21:34] with integrity,
[21:36] civility, and diligence. I encourage
[21:38] each of you to give your very best to
[21:40] this case.
[21:42] Neither Mr. Robinson nor the people of
[21:44] Utah deserve anything less than the fair
[21:47] and impartial administration of justice.
[21:52] In regards to the next hearing, council
[21:54] >> is right now being held at the Utah
[21:56] County Jail. He was scheduled to appear
[21:58] in person today, but then Friday we were
[22:00] notified that Robinson will not be
[22:01] present in person for today's hearing.
[22:04] We're told possibly because it's a short
[22:06] hearing and it doesn't make sense to
[22:08] transfer Robinson today. Now, in the
[22:10] hearing, Robinson and his newly
[22:11] appointed attorney will make a decision
[22:13] whether they want a preliminary hearing
[22:15] where the judge will decide if there's
[22:16] enough evidence to take this case to
[22:18] trial. While prosecutors have already
[22:20] released a significant amount of
[22:22] evidence, including what they say is
[22:23] Robinson's DNA on the trigger of a rifle
[22:26] believed to be the murder weapon and
[22:28] text messages after the shooting in
[22:30] which Robinson allegedly confessed to
[22:31] his lover. Now, Robinson faces the death
[22:34] penalty here in Idaho, charged with a
[22:35] long list of crimes. And a longtime
[22:37] criminal defense attorney here in Utah
[22:39] tells us Robinson's attorneys are likely
[22:42] already strategizing to keep him alive.
[22:46] In a death penalty case, there's two
[22:48] parts. There's guilt and there's
[22:49] punishment. And we haven't dealt with
[22:51] the guilt part first. So, the defense is
[22:53] going to focus on that first. But all
[22:55] the while, they're going to be thinking
[22:56] about the penalty phase. All the while,
[22:58] they're going to be looking at
[22:59] mitigation and ways to potentially save
[23:01] his life.
[23:04] >> So, Harris, we will be live uh inside
[23:07] and outside of the courthouse today.
[23:09] We'll keep you updated,
[23:09] >> but the court proceeding happened where
[23:11] it was like an initial council for the
[23:14] defendant. They introduced the council
[23:15] and they obviously convened to create
[23:18] another uh um hearing. I don't know what
[23:21] the hearing is called, but a hearing so
[23:22] they can begin to articulate their
[23:24] position because he just secured
[23:26] counsel.
